Welcome to Growthkul.com ("Growthkul," "Company," "we," "us," or "our"). Terms & Conditions apply when using our website and services. By accessing our website and services, you accept these terms.

In case you do not accept the following terms, please stop using our website and services.

01. Scope of Services

Growthkul delivers various professional services that include but are not restricted to:

  • Branding Strategy & Design
  • Corporate Video Creation
  • Factory Videos
  • TV Commercials
  • Digital Marketing Services
  • Website Development
  • Services for Pitch Deck & Presentation Design

All the services are provided on the basis of proposal or contractual agreements or correspondence.

02. Project Execution & Payment

  • All our projects commence only after receiving written approval and agreed upon payment terms.
  • The advance payment for the projects can be requested by us before the beginning of any project.
  • Payment schedule for every project is discussed and mentioned in the proposals and other project-related correspondence.
  • Lack of payment may lead to stopping the execution of the project.
  • All the payments made are not refundable unless specified in writing.

Taxes like GST are levied according to the Indian norms.

03. Intellectual Property Rights

  • Final products will belong to the client only after the full payment has been made.
  • The right to include the final products into Growthkul portfolio belongs to Growthkul unless an NDA says otherwise.
  • • Raw video footage, working files, editable files and project assets belong to Growthkul unless specified otherwise in writing.

Use of Growthkul's intellectual property without authorisation is forbidden.

04. Client Obligations

The Clients promise to:

  • Provide information related to the project
  • Deliver all the content required on time
  • Designate one person as a point of contact
  • Own all materials provided to Growthkul legally

Late approvals from the client can affect the timeline of the project.

05. Revisions Policy

  • The number of revisions will be indicated in the project proposal.
  • Extra revisions may lead to additional costs.
  • If major changes are made to the scope of the project approved initially, the project will be considered new work.

06. Project Timelines

Timelines are provided to estimate the project completion date based on the scope and responsiveness of the client. Growthkul is not responsible for delays due to the following factors:

  • Client-side delays
  • Third parties
  • Changes to platform policies
  • Force majeure

07. Limitation of Liability

Growthkul is not liable for:

  • Consequential business losses
  • Variability in campaign performance
  • Income or earnings losses
  • Algorithmic shifts on platforms
  • Potential vendor issues

Our liability, in case of any, would not exceed the total cost of the service charge for the particular project.

08. Confidentiality

Growthkul commits to protecting the confidentiality of sensitive information received from the client for the project.

Confidentiality does not cover information available in the public domain or mandated by law.

09. Termination

Termination of services can be initiated by either party through a written notice as per the contract terms.

Upon termination:

  • The work performed until the date of notice will be invoiced.
  • The advance amount cannot be refunded
  • The final deliverable will be handed over only after the settlement of dues.

10. Governing Law

The agreement of these terms will be governed by Indian laws.

Jurisdiction: Faridabad, Haryana courts exclusively possess jurisdiction.
